SAMPLE MORTGAGE

SAMPLE MORTGAGE     This Mortgage is made by [list name of person(s) mortgaging the property], an individual with an address of [list address of mortgagor], being married, ("Mortgagor"), to [list name of person receiving the mortgage], an individual with an address of [list address of mortgagee], ("Mortgagee").
    Mortgagor is indebted to Mortgagee in the principal sum of $[e.g. 50,000.00], with interest at the rate of [e.g. 10.00] percent per year, payable as provided in a certain [e.g. promissory note or bond] dated [date instrument was signed]. The terms and conditions of such [e.g. promissory note or bond] are incorporated herein by reference.

    Therefore, to secure the payment of the above indebtedness, Mortgagor hereby mortgages and conveys to Mortgagee all the following real estate:

    Subject to: [list any encumbrances the mortgage will be "subject to," e.g. first mortgage, etc.]

    Subject to all valid easements, rights of way, covenants, conditions, reservations and restrictions of record, if any.

    To have and to hold the same, together with all the buildings, improvements and appurtenances belonging thereto, if any, to the Mortgagee and Mortgagee's heirs, successors and assigns forever.

    Mortgagor covenants with Mortgagee that:

    1. Mortgagor will promptly pay the above indebtedness when due;

    2. Mortgagor will promptly pay and discharge all real estate taxes, assessments and charges assessed upon the property when due, and in default thereof, Mortgagee may pay the same and such amounts will also be secured by this Mortgage;

    3. Mortgagor will keep the buildings and improvements on the property, if any, insured against loss by fire and other casualty in the name of Mortgagee in such an amount and with such company as shall be acceptable to Mortgagee, and in default thereof, Mortgagee may effect such insurance and such amounts will also be secured by this Mortgage;

    4. Mortgagor will neither make nor permit any waste upon the property and will maintain the property and any improvements in good repair;

    5. Mortgagor will not remove or demolish any building or improvement on the property without the consent of Mortgagee;

    6. If Mortgagor shall sell, convey or transfer, voluntarily or involuntarily, all or any interest in the above property, Mortgagee may, at its option, declare the entire indebtedness secured hereby to be immediately due and payable;

    7. Mortgagor hereby assigns to Mortgagee all rents and profits of the property, if any, as additional security for the above indebtedness;

    8. Mortgagee shall be entitled to the appointment of a receiver in any action to foreclose this Mortgage; and

    9. Mortgagor will warrant and defend the title to the property against the lawful claims and demands of all persons.

    If any payment required under such [e.g. promissory note or bond] is not paid when due, or if default shall be made by Mortgagor in the performance of any agreement, term or condition of this Mortgage or such [e.g. promissory note or bond], Mortgagee may, at its option, declare the entire indebtedness secured hereby to be immediately due and payable and may enforce payment of such indebtedness by foreclosure of this Mortgage or otherwise, in the manner provided by law. Mortgagor shall pay all costs and expenses, including reasonable attorney's fees, incurred by Mortgagee by reason of Mortgagor's default.

    Provided, however, that if Mortgagor shall pay the above indebtedness and faithfully perform all agreements, terms and conditions of this Mortgage and such [e.g. promissory note or bond], then this Mortgage shall be null and void.

    The rights and remedies of Mortgagee herein are cumulative, not exclusive, and are in addition to all other rights and remedies available to Mortgagee at law or equity. Failure of Mortgagee to exercise any right or remedy at any time shall not be a waiver of the right to exercise any right or remedy on any future occasion.

    If any provision of this Mortgage shall be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    I, [list name of mortgagor's spouse], of [list address of mortgagor's spouse], spouse of [list name of person(s) mortgaging the property], in consideration of the above sum and other good and valuable consideration received, do hereby waive and release to Mortgagee all rights of dower, curtesy, homestead, community property, and all other right, title and interest, if any, in and to the above property.

Catalog of Federal Domestic Assistance
Here's government freebies to the tenth power! The U.S. Government has a Web site called The Catalog of Federal Domestic Assistance (C.F.D.A.). This on-line catalog lists almost every government public assistance and incentive grant program available. However, the best part is that it also tells you in plain English what the programs are for, who they're for, what it takes to be eligible, how much money is allocated to the agency managing the program and (most importantly), who to contact to apply for a grant.

As if that wasn't good enough, to make things even easier, all the above information is searchable on the site by using a keyword search utility located at the bottom of the welcome page. Just plug in the information you're looking for and their search engine finds links to details on programs relevant to that subject. Here's an example. We typed in "women starting a business" and got 300 links back on 10 query results pages. (Click here to see an example of the results). Each link takes you to an information page with complete details on the specific grant or program. The search utility is fast, easy to operate and very accurate.

The bottom line here is that the government has provided a free resource to access information on just about any federal grant program. However, as with any data resource, you must spend the time to do the research to find what you want. Good luck! U.S. only.

As apposed to the Catalog of Federal Domestic Assistance which is nothing more than a flat file database of links to information on federal program grant funding, this government site lists links that take you right to the managing agency's web site.

This is not a comprehensive guide but rather a gateway to many other resources you will find within the government's web pages." The site makes finding the correct agency to apply for grants easy because they list the programs in categories and then break them down by agency into sub categories.

Categories include Education, Employment and Training, Finances, Housing, Family Support, Food and Nutrition, Health, Public Safety and Cost Cutting Incentives. Each sub category takes you to the managing agencies Web site. There you get details on the grant programs along with application information direct from the horses mouth so to speak. In addition to details on grants, this site offers a wealth of other free information resources for a particular area of interest plus a special section for kids. U.S. only.

Health insurance reform requires that new group or individual health plans created or purchased since March 23, 2010, cover 100 percent of the costs of preventive care. That means you don't have to pay a deductible, coinsurance or copay for a variety of tests and treatments.

Keep in mind, though you still might have to pay a copay for an office visit if the preventive care is billed separately. Also, the law requires health plans to provide this fully-covered care only through in-network clinicians.

Here are 10 new health insurance "freebies." All of the following testing recommendations come from guidelines established by the U.S. Preventative Services Task Force.

1. Diabetes, blood pressure and cholesterol tests

High blood pressure and high cholesterol levels increase the risk for heart disease. Health insurance reform now covers tests for these conditions.

Blood pressure screening is recommended for all adults. Screening for Type 2 diabetes is recommended for adults with high blood pressure.

Cholesterol screening is recommended for:

Men 20 to 34and women 20 and older who are at risk for heart disease
All men 35 and older
2. Breast, cervical and colon cancer screenings

The American Cancer Society estimates health reform preventive provisions could double cancer screening rates among the newly insured, thereby saving tens of thousands of lives a year.

"Evidence shows that we could prevent as many as two-thirds of cancer deaths in this country with a proper focus on prevention," says John Seffrin, CEO of the American Cancer Society Cancer Action Network.

Under health insurance reform, fully covered screenings include:

Mammograms to screen for breast cancer every one to two years for women over 40
Regular pap smears to screen for cervical cancer for sexually active women
Colonoscopies to screen for colon cancer for adults over 50
3. Health education counseling

Want to quit smoking but don't know how? Need advice on how to cut down on alcohol? Health counseling is fully covered to help you achieve these goals and others, such as how to improve eating habits and treat depression.

Counseling is eligible for coverage if it comes from your primary care doctor or a specialist or program referred by your doctor. Talk to your physician and check with your insurance plan to see what is covered.

"For decades our health care system has waited to treat people until they get sick, but the Affordable Care Act shifts the emphasis to disease prevention and management as well as improved wellness and quality of life," Seffrin says.

4. Routine vaccines

You don't have to pay anything out of pocket to get your kids immunized, except perhaps a copay for an office visit if the immunizations are billed separately. Fully covered vaccines include hepatitis A and B; tetanus, diphtheria and pertussis; measles, mumps and rubella; varicella (chickenpox); and other standard recommended shots. Routine vaccines for adults are also covered.

5. Flu shots

Each year, somewhere between 5 percent and 20 percent of the U.S. population gets the seasonal flu, according to the Centers for Disease Control. Most people recover, but flu can be lethal.

New plans now must fully cover the cost of flu shots. The CDC recommended vaccination for everyone 6 months and older during the most recent flu season.

6. Counseling and screening for healthy pregnancies

The U.S. infant mortality rate is about seven deaths for every 1,000 live births, disturbingly high for an industrialized nation, according to the U.S. Department of Health and Human Services. About 8.2 percent of babies have a low birth weight, an increase of 17 percent since 1990.

Under health insurance reform, fully covered services during pregnancy include:

Screening for conditions that can hurt women or their babies, including iron deficiency, hepatitis B, a pregnancy-related immune condition called Rh incompatibility and a bacterial infection called bacteriuria
Counseling from a doctor to help pregnant women quit smoking and avoid alcohol
Breast-feeding counseling and education to help nursing mothers.
7. Well-baby and well-child visits

Children in the United States receive recommended health care less than half of the time, according to a 2007 study from the RAND Corporation, Seattle Children's Hospital Research Institute and the University of Washington School of Medicine.

Under health insurance reform, fully covered services include:

Screenings and health counseling to prevent and treat obesity among children, depression among adolescents, and dental cavities and anemia.
Routine vaccinations and boosters
Well-child visits to the doctor from birth to age 21
8. HIV and sexually transmitted disease screening

A new system to track HIV infection estimates that 56,300 U.S. residents were newly infected with the disease in 2006, the latest year such statistics are available, according to the CDC.

Screening for HIV and sexually transmitted diseases and behavioral counseling to prevent infection are now fully covered:

9. Osteoporosis screening

Osteoporosis occurs when bones become more porous and lose mass, making them susceptible to fractures and breaks with even simple activities, such as picking up a child, bumping into furniture or sneezing.

Health reform calls for routine screening for osteoporosis, which is recommended for all women 65 and older and for women 60 to 65 who are at increased risk for the condition.

10. Obesity screening and weight loss counseling

Two-thirds of Americans qualify as overweight or obese, according to the National Institutes of Health. Even more startling, 17 percent of women and 11 percent of men are severely obese.

Obesity increases risk of Type 2 diabetes, heart disease and a host of other health problems.

Screening for obesity and intensive health counseling and education now is fully covered to promote sustained weight loss for obese adults and obese children 6 and older. Your primary-care doctor may offer the health counseling or refer you to a specialist, such as a dietitian. Always check with your health plan before you schedule services to make sure they qualify for free coverage.
